ACKNOWLEDGMENT OF RISKS, ASSUMPTION OF RISK AND RESPONSIBILITY, AND RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS

THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

HEALTH & SAFETY WAIVER

All persons using the sauna at ZenZoo Spa, Rose Cottage Tavern, do so at their own risk.

Alcohol and nudity are not permitted in the sauna. ZenZoo Spa operators reserve the right to refuse admission to intoxicated persons.

Children under 16 are NOT PERMITTED unless otherwise agreed with staff. 

All hanging jewellery should be removed before entering the sauna to prevent burning.

All persons using the sauna do so at their own risk. If you have any reservations regarding sauna use, it is essential that you consult your GP before making a booking.

You must not use the sauna if you:

  • suffer from high or low blood pressure or any heart or circulatory disorder or suffer from epilepsy or diabetes;
  • are pregnant;
  • are prone to dizziness or fainting;
  • have any fungal infections or open wounds on your body or feet;
  • have any medical condition, such as anhidrosis, that interferes with your ability to sweat;
  • are taking or are under the influence of any drugs, alcohol, medication, or other substance affecting your mental or physical state;
  • are experiencing any symptoms of COVID-19 at the time of use and have had recent onset of any of the following:
    • A new continuous cough;
    • A high temperature;
    • A loss of, or change in, your normal sense of taste or smell (anosmia).

All persons using the cold plunge do so at their own risk. It is your own responsibility to ensure that you are capable of safely entering and using the cold plunge and can handle exposure to cold temperatures and other associated risks.

ACKNOWLEDGMENT OF RISK

I/We assume all risk and responsibility for death, personal injury, damage to personal property and loss of personal property that I/we sustain in connection with my/our participation in the Sauna and/or cold plunge, except to the extent such damages, injuries, or death results from conduct that constitutes greater than ordinary negligence under UK law.

I/We have been provided the opportunity to participate in ZenZoo Spa at Rose Cottage Tavern (“the Spa”), including use of the sauna and/or cold plunge, and voluntarily agree as follows:

My/My group's participation in the Spa involves known and unknown risks, dangers, and hazards that may cause death, personal injury, damage to personal property and loss of personal property.

The risks and consequences I/we are acknowledging include, but are not limited to:

  • Uneven or slippery surfaces caused by water or other substances;
  • Exposure to cold and hot temperatures;
  • Exposure to hot equipment and steam;
  • Increased internal body temperature;
  • Collisions or contact with other persons and objects inside or outside of the Sauna;
  • Exposure to airborne illnesses or transmittable diseases;
  • Defects or weaknesses in the design, construction, repair, or modification of the Sauna or Spa facilities;
  • Visible and invisible natural or man-made hazards in or around the Spa;
  • Other foreseeable and unforeseeable risks that contribute to the unpredictability of my/our participation in the Spa.

ASSUMPTION OF RESPONSIBILITY

I am / We are responsible for my/our own safety and personal property. I/We cannot and will not rely on anyone other than myself/ourselves to keep me/us or my/our personal property safe before, during, or after participating in the Sauna or Spa facilities.

My/Our participation in the Sauna and Spa facilities is voluntary and I/we can refuse to participate or quit participating at any time for any reason.

GROUP BOOKING RESPONSIBILITY

If you are making this booking on behalf of a group, it is your responsibility to make your group aware of the terms and conditions and to practice safe sauna use. Please share the details provided here.

SAUNA ETIQUETTE

Sauna etiquette must be adhered to at all times as follows:

  • Removing footwear and washing feet in the bucket provided before entering the sauna;
  • Entering and exiting the sauna in a safe manner;
  • Keeping access points clear to allow other users to exit safely and swiftly if needed;
  • Sitting on a towel at all times;
  • Staying in the sauna for no longer than 15 minutes at a time (we recommend 5–12 minute sessions). No more than 5 minutes for children;
  • Asking other sauna users before gently pouring a small amount of water onto rocks;
  • Drizzle, don't dump water — too much steam at high temperatures can be dangerous and cause burns;
  • Pouring too much water on the rocks will also cool the stove and bring the overall sauna temperature down;
  • Only pouring the provided 'sauna water' on the stove and nothing else — NO essential oils / other liquids, as these are a fire risk;
  • Not touching any part of the stove, stove cage or rocks;
  • Glass is not permitted inside the sauna. Please bring your own water bottle and leave it in the changing area;
  • Getting changed within your booked time slot, if you are using the changing room;
  • Telling someone inside the sauna if you feel dizzy or light-headed or ill and asking for help to leave;
  • Removing make-up and skincare products for hygiene reasons;
  • Ensuring you have not dyed your hair within the previous 72 hours;
  • Please do not take photographs or videos during community social sessions to respect our other guests.

ZenZoo Spa takes no responsibility for the damage or loss of customers' property or injury within the sauna or Spa site, except where liability cannot lawfully be excluded.

ADMISSION POLICY

ZenZoo Spa operators reserve the right to refuse admission for any reason that may be deemed a health and safety risk. ZenZoo Spa operators reserve the right to request a person leave a session for any reason that may be deemed a health and safety risk, dangerous or offensive to others.

Refunds will not be offered to anyone refused admission or requested to leave, subject to any rights the customer may have under applicable law.

PARENT/GUARDIAN CONSENT

If the participant is under 16 years of age, the parent or legal guardian must also agree to the below:

I am the parent or guardian of the minor child named above and confirm they are 6 years old or over.

I have the legal authority to execute the above agreement on his or her behalf.

I hereby give my full consent and approval for my child to participate in the Sauna.

I have read the above agreement and I intend for it to completely bind me and my minor child.

I hereby fully enter into and execute this agreement on my own behalf and on behalf of my minor child.

WAIVER AND RELEASE FROM LIABILITY; COVENANT NOT TO SUE

I, for myself and group and for our personal representatives, executors, administrators, heirs or next of kin, forever waive, release, discharge, agree to hold harmless, and covenant not to sue ZenZoo Spa, Rose Cottage Tavern, and their owners, shareholders, members, partners, employees, officers, directors, agents, and other affiliated persons or entities from any and all liability for any death, personal injury, damage to personal property, loss of personal property, costs, expenses, legal fees, actions, causes of action, suits, obligations, judgments and claims of any nature that I sustain in connection with my participation in the Sauna or Spa facilities, except to the extent such damages, injuries, or death result from conduct that constitutes greater than ordinary negligence under UK law or where liability cannot lawfully be excluded.

INDEMNIFICATION

I/We indemnify and agree to hold harmless ZenZoo Spa, Rose Cottage Tavern, and their owners, shareholders, members, partners, employees, officers, directors, agents, and other affiliated persons or entities from any and all liability for any death, personal injury, damage to personal property, loss of personal property, costs, expenses, legal fees, actions, causes of action, suits, obligations, judgments and claims of any nature arising from, or in connection with, my participation in the Sauna or Spa facilities, except where such liability cannot lawfully be excluded.

SEVERABILITY

Pursuant to UK law, nothing in this agreement purports or intends to waive liability for damage, injuries, or death resulting from conduct that constitutes greater than ordinary negligence or where liability cannot lawfully be excluded.

If any provision of this agreement is held invalid, such provision will be severed from this agreement, but the remaining provisions of this agreement will remain in full force and effect.

I/We have carefully read the ZenZoo Spa at Rose Cottage Tavern Terms & Conditions and understand its contents.

I am aware that by signing this agreement, I am waiving certain valuable rights, including the right to sue others for certain claims, to the extent permitted by law.

PERMISSION FOR MARKETING PURPOSES

I/We grant permission to ZenZoo Spa and Rose Cottage Tavern, its representatives and employees, the right to take photographs of me/us and my/our property in connection with the above-identified subject.

I/We authorise ZenZoo Spa and Rose Cottage Tavern, and its assignees and transferees, to copyright, use and publish the same in print and/or electronically.

I/We agree that ZenZoo Spa and Rose Cottage Tavern may use such photographs of me/us with or without my/our name(s) and for any lawful purpose, including, for example, purposes of publicity, illustration, advertising, and print/web content.

PRIVACY POLICY

This privacy policy explains how ZenZoo Spa at Rose Cottage Tavern will process the data relating to you that you provide to us, or that we may collect when you visit our website or use our services.

We are committed to protecting the personal data that we obtain. The privacy and confidentiality of our clients and visitors matter to us. We will deal with your personal data in compliance with all current applicable data protection laws.

Our website may contain hyperlinks to third-party websites. These third-party websites operate independently from us, and we cannot accept any responsibility or liability for the privacy practices of such third parties nor the availability of these external sites or resources. The appearance of such links is not an endorsement. Should you use these websites, such use is at your own risk and we would advise that you review their respective privacy policies.

How do we collect your data?

Contact Form – When you complete a contact form, we collect your name, email address, telephone number and any further information you choose to provide in your message.

Telephone Data – We will only collect personal information that you consent to provide to us in order to deliver a service.

Email Data that you provide – When you contact us via email, we will retain your email and our response to it for as long as the business issue remains and there is a legitimate interest. We store this data for five years after your last interaction with us, unless you withdraw consent.

Face to Face Contact – If you provided your contact details to us face to face, we may contact you via email, post or telephone. The legal basis for this is legitimate interest. We store your data for five years after your last interaction with us, unless you withdraw consent.

Cookies & Analytics – Our website may use cookies and website analytics to evaluate and improve our website, personalise your experience and offer the best, most accessible service possible to all of our customers.

Existing customers

If you are already a customer of ZenZoo Spa, we may hold your data under the legal basis of legitimate interest and may send you marketing materials, unless you withdraw consent.

Marketing

Where we provide you with information about our services or offers, including via newsletters or SMS campaigns, or if we contact you for market research purposes such as surveys and feedback requests, we will only use your personal information in accordance with laws relating to marketing directly to individuals and in pursuit of our legitimate interest of marketing our business.

If you have asked to be added to our mailing list, we may provide your details to a third-party company that helps us to produce and manage our newsletters. We provide these communications on the basis that you have asked to receive them.

If you change your mind, you may opt out at any time via the unsubscribe feature that appears in our emails or SMS messages, or by contacting us directly.

YOUR RIGHTS IN RELATION TO THE PERSONAL DATA THAT WE PROCESS

You have the following rights over the way we process personal data relating to you. We aim to comply without undue delay, and within one month at the latest:

  • to ask for a copy of data we are processing about you and have inaccuracies corrected;
  • to ask us to restrict, stop processing, or to delete your personal data;
  • to request a machine-readable copy of your data, which you can use with another service provider. Where it is technically feasible, you can ask us to send your details directly to another provider if you prefer;
  • to make a complaint to a data protection regulator.
